These Terms and Conditions apply when you visit or buy from HushJams Audio through this website. By placing an order, you agree to these terms.

1. About HushJams Audio
HushJams Audio is an online store selling a portable MP3 player for screen-free music, stories and audio use. We sell directly to customers online and may use trusted third-party suppliers and fulfilment partners to store, pack and send orders.

2. Product information
We do our best to keep product descriptions, photos, pricing and availability accurate. Small differences in colour, packaging, accessories or screen display may occur depending on supplier batches and device screens.

The MP3 player is intended for general audio playback. A computer or compatible device may be required to load music or audio files. Customers are responsible for using legally obtained audio files and for making sure the file formats they use are compatible with the product.

3. Children's use and safety
Our product is intended to be set up and supervised by an adult. It should not be used by children under 3 years old due to small parts and accessories. Please keep charging cables, memory cards and packaging away from young children.

To protect hearing, we recommend keeping the volume at a safe level and limiting long listening sessions. Parents and carers are responsible for supervising use and choosing age-appropriate audio content.

4. Orders and payment
Orders are accepted when payment is successfully processed and we send an order confirmation. Prices are shown in Australian dollars unless stated otherwise. We may cancel and refund an order if an item becomes unavailable, there is a pricing or listing error, or we cannot fulfil the order for a reasonable reason.

5. Shipping and fulfilment
Orders may be packed and shipped by our third-party supplier or fulfilment partner. This means your parcel may be sent directly from the supplier rather than from our own premises.

Estimated delivery times are estimates only and can be affected by stock availability, courier delays, customs processing, public holidays and regional delivery networks. We will provide tracking details where available. If a delivery issue occurs, contact us and we will help follow it up with the carrier or fulfilment partner.

6. Stock availability
Stock availability can change quickly because products are fulfilled by supplier inventory. If an item you purchased becomes unavailable after checkout, we will contact you and offer a refund, replacement option or another reasonable solution.

7. Returns, refunds and consumer guarantees
Your rights under the Australian Consumer Law are not limited by these terms. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

If your item arrives faulty, damaged, unsafe, not as described, or develops a problem, please contact us with your order number and clear photos or videos of the issue so we can assess the best remedy.

We do not have to provide a refund for change-of-mind purchases, accidental orders, or compatibility issues where the product matches the listing and there is no fault. We may choose to help with a change-of-mind return where practical, but return shipping and condition requirements may apply.

8. Cancellations and address changes
Please contact us as soon as possible if you need to cancel or change an order. Once an order has been sent to the supplier or carrier, we may not be able to cancel it or update the shipping address.

9. Customer responsibilities
You are responsible for providing accurate order, contact and delivery details. You are also responsible for checking product compatibility before purchase, safely charging and using the product, and following any care instructions included with the item.

10. Website use
You must not misuse this website, interfere with its security, copy our store content for commercial use without permission, or use the site for unlawful activity.

11. Limitation of liability
To the extent allowed by law, HushJams Audio is not responsible for indirect losses, lost data, lost audio files, misuse of the product, or delays outside our reasonable control. Nothing in these terms excludes rights or remedies that cannot be excluded under Australian Consumer Law.

12. Changes to these terms
We may update these Terms and Conditions from time to time. The version published on this page applies at the time you place your order.
